Terms of Service

These Terms govern use of Sleedu Arena ("the Service"), operated by Win Elements LLC ("WinElements," "we," "us"). By creating a teacher account or using the Service, you, and the school you represent if you use the Service in your work, agree to these Terms. If a school or district and WinElements sign a separate written agreement, that agreement controls where it conflicts with these Terms.
1. The Service
Sleedu Arena lets teachers create or upload classroom games, have students play them, and track scores in a simple gradebook with live leaderboards. Teachers create their own accounts. Students do not create accounts; they play using codes and PINs issued by their teacher, or, for schools approved by us, their school Google account.
2. Accounts and responsibilities
- You must be an adult educator or school staff member to create a teacher account, provide accurate information, and keep your credentials confidential. You are responsible for activity under your account and for the codes you issue to students.
- You are responsible for using the Service in accordance with your school's policies and applicable law, including any rules on student data. Do not enter students' names or other identifying information into the Service unless your school's policies allow it.
- Administrators of a school or district that licenses the Service are responsible for managing their teachers' use and for the accuracy of information they provide to us.
- You agree not to misuse the Service, including attempting to access another teacher's or student's data, probing or disrupting the Service, uploading malicious code, circumventing plan limits or attempt limits, or using the Service for any unlawful purpose.
3. Plans and fees
The Service offers a free plan (Lite) with usage limits and a paid plan (Premium) with additional features, as described in the Service. Premium subscriptions are billed through Stripe at the price shown when you subscribe and renew automatically until cancelled; you may cancel at any time from the Plan page, and access continues to the end of the paid period. We may change plan features or prices with reasonable advance notice; changes to the price of an existing subscription take effect at the next renewal after notice. Schools and districts may purchase licenses for their teachers under a separate agreement. Fees are non-refundable except where required by law.
4. Your content
As between the parties, you own the questions, games, images, and other content you create or upload ("Your Content"), and the scores and records for your classes. We process them only to provide the Service, as described in our Privacy Policy.
You are responsible for Your Content: you must have the right to upload it, and it must not infringe others' rights, contain malicious code, collect personal information from students, or be inappropriate for a K-12 audience. Uploaded games run in an isolated frame and must follow the technical guidelines in the Service. We may remove content that violates these Terms.
5. Shared library
If you choose to share a game or questions to the Arena library, you grant other Arena teachers a non-exclusive, worldwide, royalty-free license to copy, use, adapt, and play that content with their students, and you grant WinElements a license to host, display, and distribute it within the Service for that purpose. You can stop sharing at any time; copies other teachers already made remain with them. Share only content you have the right to share, including images. Your display name, if you set one, appears on shared content.
6. AI-generated content
The Service can draft questions using an AI model from text you provide. AI output may contain errors. You are responsible for reviewing questions before using them with students. AI-drafted content you accept becomes part of Your Content. Do not submit student names, student work, or other personal information to the AI feature.
7. Intellectual property
The Service, including its software, design, and branding — Sleedu, Sleedu Arena, Safe Pouch®, and WinElements — is owned by Win Elements LLC and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable right to use the Service for teaching. See our Copyright Policy.
8. Availability and support
We work to keep the Service available and secure, including automatic backups, but the Service is provided without a guaranteed uptime commitment unless separately agreed in writing. We may perform maintenance and modify features over time. Support is available at hello@winelements.com.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Sleedu Arena is a practice and engagement tool. Scores are reported by games running on students' devices and may be affected by device, network, or student behavior; teachers should exercise judgment before using scores for high-stakes grading. The Service is not a system of record for official grades.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WINELEMENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU OR YOUR SCHOOL PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR ONE HUNDRED US DOLLARS IF NOTHING HAS BEEN PAID). Some jurisdictions do not allow certain limitations, so parts of this section may not apply.
11. Termination
You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate access for material breach of these Terms, security risk, non-payment, or legal requirement, with notice where practicable. Upon termination, the data deletion terms of the Privacy Policy apply.
12. Changes to these Terms
We may update these Terms; material changes will be notified to teachers by email with reasonable advance notice. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except where the law applicable to a public school requires otherwise.
